In United States v. Strandlof (No 10-1358), the Tenth Circuit held that the Stolen Valor Act, criminalizing certain false claims regarding military awards and honors, did not violate the First Amendment. In so doing it broke from the Ninth Circuit, the only other circuit to have considered the issue, which held the Act to be unconstitutional. Judge Tymkovich wrote the majority opinion, joined by Judge Baldock. Judge Holmes dissented.
