The Tenth Circuit's whopping 59-page opinion, written by Judge Holmes and joined by Judges Kelly and McConnell, is here. The upshot (assuming the government does not obtain an en banc reversal of the panel's decision) is likely to be a shorter prison sentence for Nacchio.
